In order to access this informational website (the “Website”), you will need to confirm and agree the following by ticking this box:
1. You confirm that you are either the legal owner or a resident under a tenancy agreement of an apartment or mews house in The Potteries, Linden Park Road, Royal Tunbridge Wells (a “Qualifying Resident”).
2. By registering as a Member of the Potteries Residents and Owners Group, also known as 1887 The Pantiles (“The Members Group”) you provide your name, email address, mobile telephone number and apartment or mews house number at The Potteries and other data volunteered or reasonably requested and then provided by you (“Your Personal Data”).
3. You also agree that The Members Group may transfer control and all rights, privileges hereunder to the freehold and/or management company or similar Residents Group once the control of the company or Residents Group is directly controlled by Qualifying Residents.
4. In doing so you agree acceptance of the data confidentiality agreement of the Website builder or subsequent web or software provider (currently Wix.com).
5. You may also agree, by ticking the appropriate box, or you may already be registered on various Social Media sites such as WhatsApp, Facebook, Zoom, Instagram and agree our contact with you through these media. By so doing you agree to and rely on the media’s own confidentiality agreement, rules and procedures and that that in the use of these media as permitted by you, some or all of your Personal Information will be available to others and hence cannot be considered confidential.
6. You agree that all your Personal Data is being shared with Michael Paynter and David Scott and all subsequent managers acting as the administrators of the Website (the “Administrators”) to enable them to maintain and administer the Website (the “Purpose”). Except as required to fulfil the Purpose or set as out below, the Administrators will keep Your Personal Data confidential.
7. You accept that the Administrators are volunteers and do not accept any personal liability for breaches of confidentiality beyond this agreement and that which can be fully recovered by the Members Group from other parties.
8. David Scott (Data Controller) and Michael Paynter (Data Manager) will endeavour to fulfil the commitments as set out in their Privacy Policy and the statutory requirements of David Scott’s registration with the Information Commissioner’s Office “ico”, registration reference number ZB293004, unless they have relinquished this responsibility to others within Members Group or subsequent Group or Company as defined in clause 3. above.
9. You give your consent that Your Personal Data can be shared with other Qualifying Residents who have access to this informational website.
10. You understand the Purpose and agree the need for Your Personal Data to be collected and understand that within the limits of the system on which it is hosted, you can access and modify or delete Your Personal Data at any time. You accept primary responsibility for managing your own data record directly or requesting the Administrators to update your data on your behalf.
11. You understand and agree that ensuring Your Personal Data is accurate and up to date is dependent on you updating your data directly or advising the Administrators of any change to Your Personal Data. You agree to notify the Administrators of any changes and updates to Your Personal Data, either through the website or directly including if you cease to be a Qualifying Resident, without undue delay.
12. You understand and accept that the Administrators will maintain Your Personal Data only for as long as necessary to fulfil the Purpose and that they will delete Your Personal Data on the earlier of your requesting that it be deleted or becoming aware that you have ceased to be a Qualifying Resident.
13. In the event of a data breach affecting Your Personal Data, the Administrators will notify you as soon as is reasonably possible of their becoming aware of any such breach.
You understand that the contents of the Website are provided on a best endeavours basis and are accurate as at the date of their being uploaded to the Website to the best of the Administrators’ information and belief. The contents of the Website are provided for your interest and benefit, but under no circumstances should you rely on them for any legal or official purpose. You agree and undertake not to hold the Administrators liable, or seek to bring any action against them, in the event that any of the contents of the Website are inaccurate or misleading
